Industrial land management measures
〔 2017 〕 39 号），特制定本管理办法。 In order to maximize the benefits of the precious and scarce land resources in the core area and accelerate the construction of the high-tech economic structure of Zhongguancun Dongcheng Park, based on the "Opinions of the Beijing Municipal Government on Accelerating Scientific and Technological Innovation and Constructing High-tech Economic Structure Land (Trial)" ( Jingzhengfa [ 2017 ] No. 39 ), specially formulated this management method.
First, the guiding ideology. Thoroughly implement the spirit of the 19th National Congress of the Communist Party of China, comprehensively implement the decision-making and deployment of the Municipal Party Committee and Municipal Government, deepen the supply-side structural reforms, effectively utilize land resources in the core area, build a highly sophisticated economic structure in Zhongguancun East City Park, and promote the high-quality development of Zhongguancun East City Park.
2. Basic principles. In accordance with the principles of "planning the use of the plan, determining the supply conditions of the industrial direction, determining the supply price in the market, and treating all land users equally", the company will organize high-end enterprises to settle in priority and supply industrial land in the park in accordance with the law.
Third, the scope of application. This management method applies to the Zhongguancun East City Park in Zhongguancun National Independent Innovation Demonstration Zone.
Fourth, industry development direction requirements. According to the requirements of Beijing, Dongcheng District and Dongguanyuan of Zhongguancun to build a sophisticated economic structure, enterprises applying for land use should be in the fields of information service industry, cultural industry, sports health industry, financial service industry, business service industry and technology service industry.
V. Prerequisites for land supply
(1) The income of the applicant shall be included in the East City Garden of Zhongguancun.
(2) The applicant enterprise must meet the business income per unit area, per capita operating income, full-caliber tax per unit area, district-level tax per unit area, per-capita total tax, district-level tax per capita, income margin, and energy consumption per 10,000 yuan of GDP. 6. Land supply and land use methods
(1) Obtain industrial land in the park by lease. After the municipal and district governments authorize the park development enterprises, the enterprises entering the park may lease the industrial land in the Zhongguancun East City Park from the park development enterprises according to law, but they may not transfer them. The maximum term of the leased land does not exceed 15 years. The rent for industrial land is subject to an annual rent system. The annual rent is proposed by the Zhongguancun East City Park Management Committee based on the land cost and industrial guidance policies of the park, and is submitted to the Dongcheng District Government for approval.
(2) Obtaining land use rights in the park by way of transfer. A flexible term transfer is implemented with a maximum transfer period of 20 years. However, major national, municipal, and district industrial projects may be appropriately extended after approval, and the maximum transfer period shall not exceed the legal maximum period for the transfer of land use rights.
(3) The way in which the park development enterprise builds and owns industrial houses. The development enterprise of the park may lease the industrial houses and various supporting service houses built and held by itself to the applicant enterprise, but they may not sell them in whole or in part or transfer the company's equity.
(4) The enterprises in the park may use the land in Zhongguancun Dongcheng Park in accordance with the law by sharing the construction land use right with the park development enterprises. In order to reduce the land use cost of the end users of the park, when the park enterprises obtain the land use rights through bidding, auction and auction, the Dongcheng District government can set up the land supply conditions through the park development enterprise to occupy the land use rights in a certain proportion of the land use rights, Share the land use right of the parcel with the park enterprises to share the expenses incurred when the park enterprises obtain the land use rights according to law.
7. Building ownership using land in the park
According to the Zhongguancun East City Park plan, the enterprises entering the park can build production and operation facilities in accordance with the law during the land lease period or the land use right transfer period. The facility is owned by the investment enterprise during the land lease period or the land use right transfer period.
Eighth, renewal procedures
If the land use period expires and the enterprise entering the park needs to continue to use the land, it should apply for renewal no later than one year before the expiration. If it meets the development plan and industrial land requirements of the park, it should go through the formalities for renting land in accordance with the law. For those who have not applied for renewal and the application for renewal has not been approved in accordance with the needs of the public interest, the Zhongguancun East City Park Management Committee and other relevant departments shall complete the exit formalities in accordance with the law of the district government and recover the leased land or the right to use the construction land.
Nine, compensation for exit of land
(1) If the Dongcheng District Government recovers the leased land in advance, the buildings that can continue to be used on the ground shall be assessed at a new level based on the replacement price to determine the compensation price.
(2) If the enterprise entering the park withdraws from the right to use the construction land in advance, the relevant department will return the paid land transfer price for the remaining years according to the agreement; for the buildings that can continue to be used on the ground, the replacement price will be combined with the new level to determine the compensation price.
(3) Where the Dongcheng District Government recovers the land use right transferred, it shall be evaluated in accordance with the law, and the compensation price shall be reasonably determined according to the fees paid by the park-enterprise when acquiring the land use right; The new degree assessment determines the compensation price.
X. Land use requirements
(1) Before signing a land supply contract, the applicant enterprise must sign a performance supervision agreement with the Zhongguancun East City Park Management Committee as an attachment to the land use contract. The performance supervision agreement includes stipulated withdrawal clauses, clear supervision and treatment measures that do not meet the entry requirements after applying for the operation of the enterprise, and an exit method that the enterprise cannot develop, construct or operate for its own reasons.
(2) The land use shall not be changed without approval.
(3) Except for the professional parks, public service platforms, and incubator operating agencies approved by the municipal government, they can lease land owned by the construction land use right or industrial buildings constructed in accordance with the law to other enterprises entering the park. Transferring, selling, or renting the land and houses on the ground transferred or rented out by the park; for the unauthorized change of land use, real estate development in disguise, etc., the Zhongguancun Dongcheng Park Management Committee shall request the relevant departments to dispose of them in accordance with laws and regulations and performance supervision agreements .
Eleven, supervision and management requirements
(1) The Zhongguancun Dongchengyuan Management Committee regularly monitors and evaluates the assessment of industrial project access and operation, publicly implements the situation, and accepts social supervision.
(2) The Zhongguancun Dongchengyuan Management Committee established a credit account for corporate land use, blacklisted untrustworthy enterprises that violated land use contracts and performance supervision agreements, and restricted their access to government-supplied land.
Twelve safeguard measures
(1) The establishment of a joint working group consisting of the Zhongguancun Dongcheng Garden Management Committee, Dongcheng Planning and Lands Branch, District Development and Reform Commission, and District Industry Promotion Bureau, and regular consultations to jointly promote the land use of Zhongguancun Dongcheng Garden.
(2) Work flow chart for the whole life cycle management of high-tech industrial land in Zhongguancun East City Park.
(3) Find out the land use situation in the East City Park of Zhongguancun, and establish a land resource account that can be used for industrial development.
(4) To study and formulate the Zhongguancun East City Park industrial access list, and specify the requirements for entry conditions, industry type, investment intensity, output efficiency (including land-based output), innovation ability, energy conservation and environmental protection of enterprises entering the park.
(5) According to the regulatory detailed planning requirements of the new version of the General Rules, formulate the space planning and industrial development plan of the East Town Garden of Zhongguancun.
(6) The Dongcheng Planning and Soil Sub-bureau is responsible for putting forward the annual plan for the industrial land of Zhongguancun Dongcheng Park and including it in the city's annual land supply plan.
(7) The Zhongguancun Dongcheng Park Management Committee has studied and proposed the annual rent standard for leased industrial land and submitted it to the Dongcheng District Government for approval.
(8) The Zhongguancun Dongcheng Garden Management Committee shall timely release to the society the information on the high-precision cutting-edge industrial land to be provided according to the land consolidation situation.
